Terms of Use

These terms are the agreement between you and Hype & Swagger Ltd ("we", "us") for using Got Game. By creating an account, you accept them.

1. Who can use Got Game

• You must be 18 or over. We check your date of birth at sign-up.
• One account per person. Your phone number identifies you.
• You are responsible for what happens on your account.

2. What Got Game is — and what it is not

The one thing we do run is Got Game leagues: leagues with a prize, which you choose to enter. Section 6 is their rules. The games played in them are still arranged between the players, like any other game.

Every game on Got Game is arranged between the people taking part. The host decides who plays, where and when. That is a private arrangement between them, and we are not a party to it.

Booking a court stays between the club and whoever books it. We do not take court bookings. When the person or club running a game or an event sets a price, you can pay them through Got Game, as section 12 explains. We do not take a cut of that price.

3. Padel carries risk, and you accept it

Playing sport can cause injury, including serious injury. Meeting people you do not know carries its own risks. You take part entirely at your own risk.

Before you play, it is on you to decide that you are fit enough, that the venue and the game suit you, and that you have whatever insurance you want. If something does not feel right, do not play.

4. How to behave

Do not:

• Harass, threaten, bully or abuse anybody.
• Post anything hateful, sexual, violent or illegal, including in photos and messages.
• Pretend to be somebody else, or set up a club you have no connection to.
• Create fake games, spam, or advertise.
• Share anybody else's personal information, including photos of them, without their agreement.
• Try to get round a block, a suspension or a deleted account.
• Scrape, copy or automate the service.

Turn up, or say you are not coming. Not showing up without a word is the thing that ruins a game for the other three, and it is what your Attendance figure records.

5. Your level, your attendance, reports and blocks

• Your level moves on recorded results, and where the number came from is always shown alongside it. Recording a result that did not happen, to move somebody's level or your own, is a breach of these terms.
• Attendance counts finished games where a register was taken and you were on the roster. It is counted, not voted on — nobody scores you.
• You can report a person, a game, a club or a message. Reports come to us, not to the person reported.
• You can block anybody. Blocking is private to you and the other person is not told.
• If somebody has blocked you, you cannot join a game they are in. The app will not tell you why, and that is deliberate: explaining it would give the block away.

6. Got Game leagues and prizes

Now and then we run a league of our own, free to enter, with a prize for the winner. This section is the rules every one of them shares. Each league's page adds its own details: where it is played, its dates, what scores, the prize, who provides it, and any rules of its own. You see all of it before you tap Enter, and it stays on the league's page throughout. Together, that page and this section are the league's official rules.

• Who runs it. Every Got Game league is run by Hype & Swagger Ltd, 20 Wenlock Road, London N1 7GU. A sponsor may provide the prize, and is named on the league's page. Apple and Google are not sponsors of any Got Game league and are not involved in it in any way.
• It is free. Nobody pays to enter, and nothing you buy, anywhere, changes your chances.
• Who can enter. Anybody with a Got Game account, which means 18 or over. A league can be limited to players who live in an area, or to a level, category or age band. Its page says so, and the app checks when you tap Enter. People who work for Hype & Swagger Ltd or for the league's sponsor, and anybody who lives with them, can take part but cannot win a prize. If one of them finishes top, the prize goes to the next player on the final table who can win it.
• One entry each. You enter once, by tapping Enter, with your one account.
• How it is won. By points from games you play and record in the app, as the league's page sets out. Nobody judges and nothing is drawn. A game counts only if it was played after you entered and by the end date. Ties are settled in the order the page gives, and nobody wins on nought points. In a league with groups, each group has its own winner and its own prize. Two doubles partners who played every game together and are still level after every tie-break win together and share the one prize.
• When it is final. The table becomes final at the end of the third day after the end date, so a result agreed in those three days still counts. At that moment the final table is written down, and it does not change afterwards.
• Playing fair. Recording a result that did not happen, arranging results with other players, or playing under more than one account is cheating and breaks these terms. Before a league is final we can take a player off its table, and we record who did it, when and why. If we find after it is final that a prize was won by cheating, we can refuse to give it.
• Telling the winner. We tell everybody on the final table in the app at 9am on the morning it becomes final, and by a push notification too if you have turned on Leagues and prizes in Settings.
• Claiming a prize. The winner claims it by emailing support@gotgamenow.com within 30 days of being told, unless the league's page gives a different time. We ask for delivery details by email; the app never stores them. If the winner does not claim in time, we offer the prize to the next player on the final table and tell them, and they then have 30 days to claim it, and so on down the table.
• The prize. It is as described on the league's page. There is no cash alternative. If the prize becomes unavailable, we will provide one of equal or greater value. We deliver it within 30 days of your claim, unless the league's page gives a longer time.
• Naming the winner. The final table, winner included, stays visible in the app to everybody who can see the league. If anybody asks, we will tell them the winner's name and county, so they can see the prize was really awarded. If you win and would rather we did not, say so when you claim; we must still give the information to the Advertising Standards Authority if they ask. We will not use a winner's name or picture in any publicity without asking them first.
• If a league cannot finish. If we have to stop a league before its end date, for example because its sponsor withdraws, we will tell everybody on it in the app. The league's page may say what happens then; if it does not, nobody wins that league's prize. We only open a league once its sponsor has given us the prize or its value, so every winner gets the prize described, or a reasonable equivalent.

7. Your content

What you post stays yours. You give us permission to store and display it inside Got Game so the app can work — showing your photo in a game's gallery to the people who were at that game, for example. That permission ends when you delete the content, except where somebody else's copy legitimately remains, such as a message you have already sent.

We can remove content that breaks these terms, and we can suspend or close an account that does.

8. Our liability

Got Game is provided as it is. We do not promise that it will be uninterrupted or error-free, or that anybody you meet through it will be who they say they are, turn up, or behave well.

To the fullest extent the law allows, we are not liable for injury, loss or damage arising from a game arranged through Got Game, from the conduct of another user, or from a venue.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, nothing here affects your statutory rights.

9. Ending it

• You can delete your account at any time: Settings → Account settings → Delete account. It is hidden immediately and erased after 30 days, and you can stop it during those 30 days with the Keep my account button.
• We can suspend or close your account if you break these terms, or if we need to protect somebody.

10. Changes, and the law that applies

If we change these terms in a way that materially affects you, we will tell you in the app before the change takes effect.

These terms, and any dispute arising out of them, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.

11. Sign-in codes by text message

Got Game sign-in codes. When you enter your mobile number in the Got Game app and ask for a code, Hype & Swagger Ltd, which runs Got Game, sends you a one-time code by text message so you can sign in. We send nothing else by text: no marketing and no reminders.

How often. One message each time you ask for a code. Message and data rates may apply.

Help and stopping. Reply HELP for help, or email support@gotgamenow.com. Reply STOP to stop texts from us. After that we cannot text you a sign-in code until you reply START.

Mobile carriers are not liable for delayed or undelivered messages. How we handle your number is in our Privacy policy.

12. Paying for a game or event

Whoever runs a game or an event (the organiser) sets its price and chooses when players pay: when they join, or on the day. A price of £0 means it is free.

• Paying when you join. You pay with Apple Pay or a card as you join. If the organiser asks first, your card is saved when you ask and charged only if they say yes.
• Paying on the day. Nothing is taken when you join. You pay the organiser at the game, in cash or in the app.
• The booking fee. Whenever you pay in the app, a small booking fee is added and shown before you pay. It covers the cost of the card payment, so the organiser receives the full price they set.
• If you drop out more than 12 hours before the start, you get the price back. The booking fee is not refunded. Inside 12 hours, or if you do not turn up, there is no refund.
• If the organiser cancels, everyone who paid gets everything back, the booking fee included.
• The organiser is paid the day after the game or event.

Payments go through Stripe. Your card details go to Stripe, not to us. To take payments in the app, an organiser sets up payouts with Stripe, which checks who they are; once that is done, players see them as a Verified organiser.

We collect your payment on the organiser’s behalf and pass it to them. What you pay for is your place in their game or event, and that is between you and them, as section 2 says. If something goes wrong with a payment, email support@gotgamenow.com.
